The following collective labour agreement concerning the minimum conditions according to the law on compulsory employment conditions for internationally assigned employees and employees who are nationally employed on a regular basis (employee assignment law, AEntG) shall be concluded.

Section 1
Area of application

1. Territorial scope of application
For the territory of the Federal Republic of Germany.

2. Operational scope of application
a) All companies and independent operational departments of the meat industry. These are companies in which

  • pigs and cattle are slaughtered and/or cut up,
  • all kinds of poultry are slaughtered and/or cut up,
  • mainly all kinds of meat and meat products are processed, portioned and/or packed.

This also comprises companies and independent operational departments which employ their employees in companies or operational departments of the meat industry (service providers of the meat industry).

b) Companies which are part of the butcher trade are not included unless they act as a service provider of the meat industry.

3. Personal scope of application
All employees, especially those who carry out tasks liable to insurance deductions according to the provisions of book VI of the code of social law - statutory pension insurance - (SGB VI) and including those who are marginally employed according to section 8 of book IV of the code of social law - common social insurance provisions - (SGB IV).
This also comprises employees of service providers of the meat industry if they are employed in companies or independent operational departments of the meat industry.

The following persons shall be excluded:
a. trainees according to the vocational training act
b. persons who demonstrably complete an internship due to school, training or university provisions.

Section 2
Minimum wages

1. The minimum wage is a wage according to section 5 subsection 1 no. 1 of the AEntG. Higher wage entitlements due to other collective labour agreements, company or individual contract regulations shall remain unaffected.

2. The nation-wide minimum wages per hour are

as of 1 August 2014            EUR 7.75
as of 1 December 2014      EUR 8.00
as of 1 October 2015          EUR 8.60
as of 1 December 2016      EUR 8.75

3. The entitlement to the minimum wage shall be due at the 15th day of the month following the month for which the minimum wage is paid at the latest.

Section 3
Terms of exclusion

A term of exclusion of 6 months from the due date of the claim shall apply for all claims arising from this collective labour agreement.

Section 4
General applicability

The parties to the collective labour agreement are obliged to jointly request the inclusion of the meat industry in the employee assignment law and the declaration of general applicability of this collective labour agreement with the aim of extending the legal norms of this collective labour agreement to all employees who fall under its area of application and who are not bound to it by way of a legal provision according to section 7 of the AEntG of the Federal Ministry for Labour and Social Affairs.

Section 5
Entry into force and duration

1. This collective labour agreement shall enter into force by 1 July 2014, but not before its extension according to section 7 of the AEntG.

2. The collective labour agreement shall expire on 31 December 2017 without any after-effects.

3. The parties are obliged to enter into new negotiations about a new collective labour agreement as of 1 July 2017.
